Trademarks

We offer a full range of services to assist clients in building and protecting the brands that are integral to their business operations.

Our services include:

Choosing a strong mark.  We guide clients on selecting marks that have the greatest chance for successful legal protection.  We steer them away from spending time and money on marks that will not be defensible against copycats and competitors.

Clearance searches.  We arrange searches for prior users of proposed trademarks and service marks and advise on the availability of the desired brand.  We analyze concurrent uses of marks that may conflict with that brand and, on occasion, negotiate co-existence agreements with other users.

Trademark registration.  We file applications for registration of trademarks and service marks with the United States Patent and Trademark Office, typically on a project fee.  Filings may include intent-to-use applications and international applications under the Madrid Protocol.

Contested proceedings.  We go to bat for clients in contested proceedings before the United States Patent and Trademark Office and the Trademark Trial and Appeal Board.

Foreign trademark protection.  We coordinating the filing and prosecution of trademark and service mark applications in other countries through a trusted network of local lawyers and trademark agents.

Making sense of cyberspace.  We protect the brand from unauthorized uses by others in cyberspace – including cybersquatters and other domain name disputes, cybergripe sites, social media, and unauthorized e-commerce. We monitor paid search practices by search engines that permit bidding on clients’ trademarks as search terms.

Enforcing trademark rights. We challenge infringing uses of identical, counterfeit, or confusingly similar trademarks through cease and desist letters and litigation in federal court and before the Trademark Trial and Appeal Board. We prosecute and defend claims involving abandonment of trademark rights, holdover licensees, domain name piracy, false advertising, passing off, and unfair competition.

Managing trademark portfolios.  We maintain a database to track clients’ collections of trademarks.  We coordinate renewal filings and registering related house marks.
